Person Receiving Treatment Rights

Rights of persons receiving AMT services which are set out in the AMT Act include:

  • To receive information about their rights via explanation of a ‘Rights Statement’ as soon as possible after admission to Assessment or Treatment (via interpreter if indicated).
  • To nominate a primary contact person (or to revoke or vary this nomination) and for the primary contact and/or the person’s guardian or decision-maker to be notified of the person’s admission and various other matters.
  • Provision of a copy of the assessment report.
  • To receive notice of AMT Tribunal hearings and orders, and to attend hearings.
  • To apply to the AMT Tribunal for variation, revocation or replacement of an order, or to appeal an order to the Local Court within a set time limit.
  • To be consulted in the preparation of an aftercare plan, and given a copy of that plan
  • To apply for access to their records.
  • To have access to a complaints procedure.
  • To be given information about community visitors, and to contact the CVP.

The Australian Charter of Healthcare Rights should be seen as an overarching statement of health care rights, describing the rights of all people using the Australian healthcare system.

Finally, the NT Code of Health and Community Rights and Responsibilities provides rights and responsibilities on both users and providers of health and community services in the Northern Territory.
